Terms of Service

1. Services Provided

BehindTheTools.ai provides AI automation systems for home service contractors, including but not limited to:

• AI-powered websites built to convert visitors into booked jobs.
• 24/7 missed call recovery via AI call answering and text-back.
• Google review acceleration following completed jobs.
• Database reactivation to re-engage dormant customer lists.

Specific deliverables, timelines, and pricing are defined in your individual service agreement or proposal.

2. Your Responsibilities

• Provide accurate business information and timely access to required accounts (Google Business Profile, phone systems, customer databases).
• Obtain proper consent from your customers before our systems contact them via SMS, phone, or email, in compliance with the TCPA and all applicable laws.
• Maintain the accuracy of customer data you provide to us.
• Use our services in compliance with all applicable laws and regulations.
• Notify us promptly of any changes to your business operations that may affect service delivery.

3. Payment Terms

Fees and payment schedules are outlined in your service agreement. Unless otherwise stated, invoices are due upon receipt. Late payments may result in suspension of services. Setup fees, where applicable, are non-refundable once work has commenced.

4. No Guarantee of Specific Results

While our systems are designed to recover lost revenue, increase reviews, and reactivate customer lists, we cannot guarantee specific financial outcomes. Results depend on factors including your call volume, customer list size, market conditions, service quality, and how you run your shop. Any metrics or case studies we share represent real results from real clients but are not a promise of identical performance for your business.

5. Intellectual Property

We retain ownership of our AI systems, prompts, workflows, software, and methodologies. You retain full ownership of your customer data, business name, branding, and any content you provide to us. Upon termination, you may export your customer data, but our proprietary systems and configurations remain our property.

6. Limitation of Liability

To the maximum extent permitted by law, BehindTheTools.ai shall not be liable for any indirect, incidental, special, or consequential damages, including lost profits, lost revenue, or business interruption, arising from your use of our services. Our total liability for any claim shall not exceed the fees you paid us in the three (3) months preceding the claim.

7. SMS & Communication Compliance

You are solely responsible for ensuring that you have obtained proper consent from your customers to receive SMS messages, phone calls, and automated communications sent on your behalf through our systems. You agree to indemnify and hold BehindTheTools.ai harmless from any claims arising from your failure to obtain such consent or from violations of the TCPA or related regulations.

8. Termination

Either party may terminate services with written notice according to the terms in your service agreement. Upon termination, we will wind down active systems within a reasonable period and provide you an opportunity to export your customer data. You remain responsible for fees incurred up to the termination date.

9. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of our engagement, including pricing, customer data, and business operations. This obligation survives termination of services.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State in which BehindTheTools.ai is registered, without regard to conflict of law principles. Any disputes shall be resolved in the courts of that jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. We'll post the updated version here with a new "last updated" date and notify you of material changes. Continued use of our services after changes take effect constitutes acceptance of the revised Terms.
